How to Form Your Own Private Express Trust – Step-by-Step We have made this as simple as possible.

Follow these stages in order:

Study the basics – read the full educational guide and the two recommended textbooks we reference (Equity & Trusts by Alastair Hudson and Weiss’s Concise Trustee Handbook).
Decide the parties – who will be Settlor, Initial Trustee(s), additional Trustees (we recommend a mix of natural persons and private limited companies), and Beneficiaries.
Prepare the documents – use our editable templates (Deed of Trust, Memorandum of Trust, Assignment of Property for house and bank account, NDAs, etc.).
Execute correctly – sign as a deed, use wet-ink signatures, witnesses, and Royal Mail Special Delivery for proof of posting.
Transfer the first assets – complete the Assignment of Property (Res 1 for real estate, Res 2 for bank account).
Register any required restrictions – e.g. use Land Registry Form RX1 if protecting the family home.
Keep records – Trustees must maintain proper accounting records (no auditor required).

Crucial point: You (or the people you appoint as Trustees) must be prepared to learn the duties and powers inside the trust deed. We will help, but we will not hand you a finished trust you do not understand.
