A Layman’s Educational Guide to Forming Private Express Trusts

Welcome to The Sovereign Trust (thesovereigntrust.net).

We are here to help everyday people learn, step by step, how to create their own Private Express Trust.

Think of a Private Express Trust in the simplest terms: it is a lawful arrangement where one person (the Settlor) places property or assets into the care of one or more Trustees to hold and manage for the benefit of chosen Beneficiaries. The Trustees hold legal title to the assets, but the real (equitable) benefits belong to the Beneficiaries. This is done under the law of equity – the same principles that have protected family wealth for centuries in English law.

Our entire website and all documents are written for complete beginners. No legal jargon without clear explanations. You do not need to be a solicitor or accountant to understand or use this material.

Our mission To make clear, accurate information about Private Express Trusts freely available so that anyone can learn and decide whether this tool is right for them. We provide sample templates and instructions so you can create your own documents if you wish.

We also offer practical assistance (by contribution) for those who want extra help – but only if you are willing to study and fully understand the trust you are creating. Trustees and Settlors must know their own trust inside out; we will not do it “for” you without your active involvement.

What you will find here

  • Simple explanations of what a Private Express Trust is and how it works

Important Private Express Trusts are lawful and recognised under English law (see the three certainties from Knight v Knight (1840) and the principles in Milroy v Lord (1862)). However, every trust is different. The templates on this site are educational examples only. You remain fully responsible for your own decisions and for understanding every clause in your final documents.
